Terms of Use

These Terms of Use ("Terms") govern your access to and use of the websites operated by The Vitality & Aesthetics Institute, PLLC ("TVAAI," "we," "us"), including tvaai.com and book.tvaai.com (the "Sites"). By using the Sites, you agree to these Terms.

1. Not medical advice; no provider relationship from the Sites

Content on the Sites is provided for general informational and educational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Using the Sites or submitting a booking request does not, by itself, create a provider–patient relationship. That relationship begins only after you complete a consultation and the required intake and consent forms with a licensed provider. See our Medical Disclaimer.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Sites and book services. Services are available only to patients physically located in the states where our providers are licensed; see States Served.

3. Booking, consultations, and treatment

Requesting an appointment through the Sites is a request, not a guarantee of treatment. All treatments are provided at the clinical discretion of a licensed provider following an appropriate evaluation, and may be declined where not clinically appropriate. Prescription medications, including any compounded medications, are dispensed only on a valid prescription issued after an evaluation; see our Telehealth Informed Consent.

4. Pricing, payment, and financing

Prices shown on the Sites are introductory or estimated and are confirmed at your visit. Final pricing depends on the services and plan determined with your provider. Payments are processed through our third-party providers. Patient financing is offered through Cherry Technologies, Inc. and is subject to eligibility and approval; TVAAI is not a lender and does not make credit decisions. Cancellation, refund, and membership terms are described in our Refund & Cancellation Policy.

5. Acceptable use

You agree not to misuse the Sites, including by attempting to gain unauthorized access, interfering with their operation, submitting false information, or using them for any unlawful purpose.

6. Intellectual property

The Sites and their content — including text, graphics, logos, and the TVAAI name and marks — are owned by or licensed to TVAAI and protected by law. Third-party product names (e.g., Botox®, Dysport®, Juvéderm®) are the trademarks of their respective owners. You may not copy or reuse Site content without permission.

7. Third-party links and services

The Sites may link to third-party services (such as financing and scheduling providers). We are not responsible for the content or practices of those third parties, and your use of them is governed by their own terms and privacy policies.

8. Disclaimers and limitation of liability

The Sites are provided "as is" without warranties of any kind. To the fullest extent permitted by law, TVAAI is not liable for indirect, incidental, or consequential damages arising from your use of the Sites. Nothing in these Terms limits any liability that cannot be limited under applicable law, and nothing here limits a provider's professional obligations to a patient.

9. Indemnification

You agree to indemnify and hold harmless TVAAI from claims arising out of your breach of these Terms or misuse of the Sites, to the extent permitted by law.

10. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules, and disputes will be resolved in the state or federal courts located in Harris County, Texas.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the Sites after changes are posted constitutes acceptance of the updated Terms.
